Discrimination – age – Council Directive 2000/78/EC – Swedish law – compulsory retirement

11 Dec 2012

European Court of Justice

5 July 2012

Compulsory retirement at the age of 67, which was permitted under Swedish law, did not amount to unlawful age discrimination under Council Directive 2000/78/EC because it was reasonably justified by legitimate aims of employment and labour-market policy. Those aims were: to avoid humiliating situations for older employees; to adapt to demographic developments; to make it easier for younger people to enter the job market; and to enable employees to adapt from employment to retirement (given that the state pension was payable from age 65)
